Constitution of The Uttarakhand Polytechnic Teachers’ Association

NAME : The name of the Association shall be "Uttarakhand Polytechnic Teachers' Association" in short "UPTA".
JURISDICTION : The Association shall operate throughout the limits of Uttarakhand.
MAIN OFFICE : Preferably capital of the State otherwise as decided by Executive Committee.
WORKING OFFICE : The Working Office of the Association shall be located at the institution to which the General Secretary belongs.
DEFINITION : Notwithstanding any thing contained in any other rules and regulations, the terms used in these rules shall be defined as under:
  1. Association: Means "Uttarakhand Polytechnic Teachers' Association".
  2. Government : Means Government of Uttarakhand.
  3. President : Means the President of the Association elected in the manner prescribed under these rules.
  4. General Secretary: Means the General Secretary of the Association elected in the manner prescribed under these rules.
  5. Rules : Means the rules of "Uttarakhand Polytechnic Teachers' Association".
  6. AICTE: Means All India Council for Technical Education.
  7. PCI: Means Pharmacy Council of India.
  8. Session: Means 1st July of the year to 30th June of next year.
  9. G.O.: Means Government Order of Uttarakhand State.
  10. Teacher: Means the Lecturer or above working in Polytechnic of the state.
  11. State: Means State of Uttarakhand.
  12. Directorate: Means Directorate of Technical Education(DTE) of the State, situated at Srinagar Garhwal.
  13. Board: Means Board of Technical Education(BTE) of the State, situated at Roorkee.
AIMS & OBJECTIVES:
  • To provide opportunity to members for exchange of views on subjects of common interest to members.
  • To work for the unity and brotherhood of the members and organize such academic and social functions/activities as may be conducive to bring the members nearer to each other.
  • To represent the Government and such other authorities as may be necessary on matters of security of service conditions of its members.
  • To create conditions conducive to increase efficiency of members in their professions, this may work as guide to its members in their day-to-day working and development of Technical Education in the State.
  • To resort legal and constitutional methods to achieve the betterment of service conditions of its members
  • To cooperate and seek cooperation from other organization having identical aims and objects in the state/country for the benefit of the society in general & for its members in particular.
  • To build and maintain healthy traditions of services.
  • To request the Government for providing all G.O. concerned to the members of Association.
  • To represent the Government for filling the promotional posts by time bound rules.
  • To get affiliation and get cooperation from other Associations.
  • To represent the Government for sanction of pay scales as per AICTE/PCI recommendations.
  • To represent the Government for provision of time scale/selection grade as per AICTE recommendations.
  • To represent the Government for provision of quality improvement program for its members in the interest of Technical Education.
  • To represent the Government for updation of Service Rules of the department according to AICTE recommendation.
PROHIBITIONS:
  • The Association shall not take part directly or indirectly in political, religious or racial matters.
  • The Association shall neither indulge nor allow its members to indulge in any activities against the Government servant conduct rules.
  • The Association shall not send any representation or deputation except in connection with a matter which is of common interest to members of the Association.
  • The Association shall not espouse or support the cause of an individual Government Servant relating to a service matter.
MEMBERSHIP:
  1. The membership of Association shall be open to the working Gazetted officers of the Technical Education Department namely:
    1. Principal, Heads, Lecturers in all disciplines/subjects, and Workshop Superintendents of various Government Polytechnics of the State.
    2. Director, Joint Director, Deputy Director of the Directorate.
    3. Secretary, Joint Secretary, Deputy Secretary, Assistant Secretary of the Board.
  2. One desirous to become a member of the Association shall apply to the General Secretary in an enrolment form prescribed for the purpose and shall deposit Rupees twenty (Rs. 20/-) as enrolment fee. After scrutiny of the papers the General Secretary shall enroll the applicant as member of the Association and shall allot him an enrolment number. The enrolment number allotted to a member will be the same serial number against which the name of applicant has been enrolled in the register/data base of membership maintained by the General Secretary.
  3. The members of the association shall have to deposit Rupees two hundred (Rs. 200/-) as annual subscription in the beginning of the financial year and latest by 30th June. This will be in addition to the enrolment fee.
TERMINATION OF MEMBERSHIP: The membership shall stand termination in the following circumstances:
  1. Non payment of annual subscription.
  2. Death of the member.*
  3. Resignation of the member from the department.
  4. Dismissal of the member from the state service.
  5. A member may continue his membership after his retirement from the service.
*In this case the Association will exempt its all dues, if any. The Association will also give full support to their family members to get all claims.
LOCAL UNITS: The Association shall have its local units at all such Polytechnics/Institutions/Offices where at least five members are working. If number of members is inadequate in any Polytechnic/Institution/Office, then these members will be considered as the member of nearby local unit. The management of these units shall be governed by the following regulations framed by the Executive Committee of the Association.
  1. Every local unit will have one Secretary dully elected by the members of local unit.
  2. The Principal/Acting Principal will be the Chairman of local unit. He will chair the meetings of Local unit. In his absence, the senior teacher will chair the meeting.
  3. The Secretary of local unit will keep contact with the General Secretary and inform about the matter of common interest from time to time.
  4. The Secretary will also collect the annual subscription plus a nominal amount to meet local unit expenditure(as decided by Local unit) from members and send only annual subscription to main office of the Association in due time.
RIGHTS OF MEMBER (S)/LOCAL UNIT (S)
  1. The members/Local units may propose to include any item(s) in the agenda of any General Body Meeting or Annual General Meeting by observing the provisions of the rules & regulations.
  2. The Local units shall have the right to receive share of funds for organizing State/National Conference/General Body meeting of the Association at the rate to be fixed in the Executive Committee.
  3. The Local unit(s)/member(s) shall have the right to receive or subscribe to all the publications of the Association free of cost or on payment as to be decided in the Annual General meeting.
DUTIES OF THE MEMBER (S) / UNIT (S)
  1. The Local unit(s)/member(s) shall abide by the rules and regulations of the Association including the amendments as per provision of the Constitution.
  2. Each Local unit shall pay/subscribe the annual subscription of its member(s) and other collection, if any, in time as per rules and decision of the General Body Meeting.
MANAGEMENT:
  1. The management of the Association shall be conducted by an Executive Committee of the following:
    1. President : 1
    2. Vice President : 02(one from each Kumaon and Garhwal Zone)
    3. General Secretary : 1
    4. Joint Secretary : 05(one from GP Srinagar, GP Nainital, GP/GGP Dehradun, and two open)
    5. Treasurer : 1
    6. Deputy Treasurer : 1
    7. Members of Executive Committee : 10% of total strength of members. One member should be from each discipline/subject whose members are not less than 10% of total strength, otherwise two or more disciplines/subjects may be merged to form adequate strength for election. At least one member from woman members.
  2. The tenure of the Executive Committee will be one session.
  3. The General Body of the Association shall elect all Executive members in its Annual General Meeting to be held each year in the month as decided by the Executive Committee, but not later than 30th June.
  4. The Executive Committee shall have the power to nominate three or four office bearers of Executive Committee in case they resign before next General Body meeting/election.
DUTIES OF OFFICE BEARERS : (A) PRESIDENT:
  1. He will preside over the meetings of the Executive Committee and general body meeting.
  2. He will have the power for casting his vote in the vote in the event of equal votes on any issue.
  3. He will provide his rulings on the matters not provided in these rules and his decisions in such matters shall be final.
  4. He will be in-charge of general supervision of the working of Association and guide the members and office bearers of Executive Committee.
  5. He will have power to sanction an expenditure up to Rupees Five thousand to the G.S., but for more, sanction of Executive Committee will be necessary.
(B) VICE PRESIDENT:
  1. The Vice Presidents shall have the same powers as that of President exercised in the absence of President.
  2. Their seniority will be official seniority in the service.
  3. He will assist the President in discharge of his duties.
(C) GENERAL SECRETARY:
  1. He will call the meetings of Executive Committee and General Body meeting as and when considered necessary and feasible. He will keep all the records of the proceedings of the meetings and take steps to execute them.
  2. He will correspond with the Government, other Authorities as may be necessary in the interest of members. The correspondence should also be communicated to Local Unit.
  3. He will attend all the meetings of the Association & its Committee(s)/Sub-Committee(s).
  4. He will be ex-officio member of all the Committee(s) & Sub-Committee(s).
  5. He will prepare annual report/account of the Association and will submit the same to the General Body with assistance of Joint Secretaries and Treasurer.
  6. He will have the powers to invite members (not exceeding four) from other Association in Executive Committee meeting with the permission of President for specific purposes.
  7. He will incur expenditures in consultations with the Treasurer in accordance with the budget provision
  8. He may have an imprest cash of Rupees One Thousand (Rs. 1000/-) for day-to-day working expenditure of the Association without seeking any sanction.
  9. He will have power to incur expenditure above Rupees One Thousand but up to Rupees Five Thousand only with the approval of President.

Note: The approval of Executive Committee is must for expenditure above Rupees Five Thousand.

(D) JOINT SECRETARIES:
  1. All J.Ss shall assist the G.S.
  2. The Seniority of J.Ss. will be based on the official seniority.
  3. The J.S.-I will work as G.S. and perform all activities of the Association in the absence of G.S. with prior approval of the President.
(E) TREASURER:
  1. He will be responsible for finance of the Association and will keep accounts and other records of income and expenditure of the funds of the Association.
  2. He will be authorized to keep Rupees One Thousand in imprest cash with the permission of President.
  3. He will not make any payment without sanction of President and will follow the financial rules of the Association.
  4. He will deposit the funds in a nationalized bank as decided by Executive Committee.
  5. He will prepare Annual Financial Statement for submission to the General Body after audit from Auditors of the Association.
(F) DEPUTY TREASURER:
  1. He will assist the Treasurer.
  2. He will work as Treasure and perform all activities of the Association in the absence of Treasure with prior approval of the President.
(G) AUDITORS:
  1. They shall audit the Financial Statement prior to present before General Body meeting.
MEETINGS AND DECISIONS :
  1. The decisions shall be taken by majority of votes.
  2. At least two meetings (gap between two meetings should not be more than six month) of Executive Committee and one meeting of General Body shall be held in a session. The General Body meeting shall be held between the month of April to June to transect the following business:
    1. to adopt the report of the work done by the Association and the audited statement of accounts;
    2. to elect the office-bearers and other members of the Executive Committee; and
    3. to transect such other businesses as may be brought forward with the permission of the President.
    Note: at least 15 days notice shall be given to members for a general meeting.
  3. The special or emergency meetings of the Executive Committee can be called by G.S., if requisition is received duly signed by one-fourth of members.
QUORUM :

One-fourth of the members of the General Body shall form quorum for General Meeting. One-third members of the Executive Committee shall form the quorum, provided that no quorum is necessary for adjourned meeting.

FUNDS :

The funds of the Association shall consist of:

  1. Enrolment fee.
  2. Annual subscription.
  3. Grants from Government or donation.

The funds of the Association shall be kept in a nationalized bank and shall be operated under the joint signatures of at least two members of Executive Committee, out of which one must be Treasurer and other should be decided by a resolution of Executive Committee.

The general funds of the Association shall not be spent on any other objects than the following, namely:

  • The payment of expenses for the administration of the Association including audit of the accounts of the general funds of the Association.
  • The payment furtherance of any cause intended to benefit Government employees in general.
AUDIT:

The Auditors of Association shall audit financial records periodically and the Financial Statement prior to present before General Body meeting.

The Auditors may call all the records of Association for periodical audit and the G.S. and Treasurer shall manage to give all records.

The books of Accounts of the Association shall be open to inspection by any member of the Association.

GENERAL :

No alteration and addition shall be made in these rules, until unless it is carried by two-third majority of votes in the annual meeting of the General Body.
